These Terms & Conditions apply to your use of the website derryntalart.com and to purchases made through the online store operated by Derryn Tal ("Derryn Tal", "we", "us" or "our").

2. Products
Derryn Tal sells original artwork and jewellery through this website.
We make every effort to ensure that product descriptions, dimensions, materials, prices and other information provided on the website are accurate and up to date.
We make every reasonable effort to display the colours of artwork, jewellery and other products as accurately as possible. However, colours can vary between screens and devices and may appear slightly different in person from how they appear on your screen.
We cannot guarantee that the colour you see on your device will be an exact representation of the physical product.
3. Product Availability
All products are subject to availability.
If we are unable to fulfil an order after it has been placed, we will contact you as soon as reasonably possible and provide an appropriate remedy, which may include a refund of amounts paid for the unavailable product.
We reserve the right to correct genuine errors in product descriptions, pricing or availability. If an error has resulted in an incorrect price being displayed, we will contact you before processing the order where appropriate.
4. Pricing
All prices are displayed in Australian dollars (AUD), unless otherwise stated.
Prices shown on the website are subject to change without notice. A price change will not affect an order that we have already accepted and confirmed.
Where applicable, GST is included in the advertised price.
Shipping and delivery charges, where applicable, will be displayed at checkout before you complete your purchase.
5. Orders
When you place an order through our website, you are making an offer to purchase the selected products.
You will receive an order confirmation by email after placing your order. This confirms that we have received your order but does not necessarily mean that your order has been accepted.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
a product is unavailable;
there has been an obvious pricing or product description error;
we reasonably suspect fraudulent or unauthorised activity; or
we are unable to process payment.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.
6. Payment
Payment must be made using the payment methods available at checkout.
You confirm that you are authorised to use the payment method provided.
Orders will generally not be dispatched until payment has been successfully received.
7. Shipping and Delivery
We primarily ship within Australia.
Available shipping options, costs and estimated delivery timeframes will be displayed at checkout where applicable.
Delivery timeframes are estimates only and may be affected by circumstances outside our reasonable control, including postal delays, courier delays, weather, natural disasters, strikes, peak periods or other unforeseen events.
Once your order has been dispatched, you may receive tracking information where tracking is available.
If your order appears to be delayed or has not arrived within a reasonable timeframe, please contact us so that we can assist.
If international shipping is made available for a particular product or by prior arrangement, additional shipping costs, delivery conditions, taxes, duties or customs charges may apply. Any applicable international shipping terms will be communicated before the order is completed.
8. Risk and Delivery
We take reasonable care when packaging products for delivery.
If a product is damaged, lost or otherwise affected during delivery, please contact us as soon as reasonably possible with your order details and, where relevant, photographs of the packaging and product.
Nothing in these Terms & Conditions limits or excludes any rights or remedies you may have under the Australian Consumer Law.
9. Returns and Refunds
All sales are final. We do not accept returns or exchanges for change of mind, incorrect selection, or no longer wanting a product.
Please carefully review the product description, images, dimensions, materials and other information provided on the product page before placing your order.

10. Faulty & Damaged Products
We take care to ensure that products are accurately described, properly packaged and of acceptable quality.
If a product is faulty, damaged, significantly different from its description, not fit for its intended purpose, or otherwise does not meet a consumer guarantee under the Australian Consumer Law, please contact us.
Depending on the circumstances and your rights under the Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy.
We will assess the issue and provide the remedy required by law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth) or applicable Australian state or territory legislation.

11. Original Artwork
Original artworks are individual works and may contain characteristics that are inherent to the artistic process.
These may include minor variations in texture, brushwork, surface finish, framing or other visual characteristics.
Such characteristics do not necessarily constitute a fault or defect.
Each original artwork is sold as the individual piece described on its product page.
12. Jewellery Care
Jewellery should be treated with appropriate care.
Depending on the materials used, exposure to water, chemicals, perfumes, lotions, cleaning products, perspiration or other substances may affect the appearance or finish of jewellery over time.
Normal wear and tear, accidental damage or damage resulting from inappropriate care does not necessarily constitute a product fault.
This does not affect your rights under the Australian Consumer Law where a product fails to meet a consumer guarantee.

Unless otherwise stated, all content on this website is owned by or licensed to Derryn Tal.
This includes, but is not limited to:
original artwork;
photographs;
product images;
illustrations;
designs;
logos;
branding;
text;
graphics; and
other creative content.
You must not reproduce, copy, modify, distribute, sell, publish or commercially exploit any website content or artwork without our prior written permission.
Purchasing an artwork or product does not transfer copyright or other intellectual property rights in the artwork to the purchaser.
Unless otherwise agreed in writing, copyright remains with the artist.
